How Much Compensation?
There are two main areas when claiming compensation general damage and special damages.
General damages are calculated on the injury you have and criteria such as how serious it is and the impact it has had on you. The following figures are a guide on what could be claimed. For a more precise figure we would need more details of your case.
Minor Whiplash
For minor injuries the compensation amount could be between: -
- £875 to £2,850 if you make a complete recovery within 1 year.
- £2,850 to £5,150 if you make a complete recovery within 2 years.
Moderate Whiplash
For moderate whiplash injuries, if the symptoms were more than minor and the injury results in suffering over a number of years and has made your more vulnerable to injury in the future the compensation amount could be between: -
- £5,150 to £9,000 where the period of recovery has been protracted and increased vulnerability to further trauma.
- £9,000 to £16,400 where there is serious limitation of movement, permanent or recurring pain, discomfort and the possible need for further surgery.
Severe Whiplash
For more severe injuries which cause long pain and suffering the compensation amount is dependant on the specific details but could be between
- £16,400 to £97,500
Special damages are for out of pocket expenses that may have occurred because of the injury sustained. Examples of these expenses include: -
